WELLBEE SOCIAL INC. , d/b/a Wellbee Academy or Wellbee (“us”, “we”, “our” or the “Company”) respect your privacy and are committed to protecting it by complying with this Privacy Policy. Wellbee Academy’s mission is to bring together educators, professionals, and learners of alternative health therapies under one platform to engage, network, publish courses, and create virtual classrooms for courses. Therefore, it is essential that the information you submit through the service be made available to other users in your country and around the world. In using our Service, Your information may also be shared with other services of which you are not a user, as well as potentially transmitted to third parties as set forth herein. This privacy policy (“Privacy Policy”) describes the privacy practices of Wellbee Social Inc. and Wellbee Academy and our subsidiaries and affiliates with respect to information, including personally identifiable data, personally identifiable information, personal information, or similar identifiable data that identifies you as an individual personally as defined under applicable law (“Personal Data”) that we collect about individuals (“You” and/or “Your”), including through any of our websites, mobile applications, or any other services or offerings which may reference this Privacy Policy (the “Services”) (all of Your data or information received by, or generated through Your use of, the Wellbee Academy services, including Personal Data defined broadly herein as “Information”). We inform you how we collect, store, access, and otherwise process information relating to our users. In this Policy, personal data (“Personal Data”) refers to any information that on its own, or in combination with other available information, can identify an individual. Privacy laws in Canada generally define “personal information” as any information about an identifiable individual, which includes information that can be used on its own or with other information to identify, contact, or locate a single person. Personal information does not include business contact information, including your name, title, or business contact information. However, we also collect information pertaining to your business, including corporate details, business transactions that are disclosed through the course of placing orders through us, and other otherwise sensitive information.

By submitting Information through our Services, you agree to the terms of this Privacy Policy, our Terms of Service, Instructor Terms, as well as any other documentation referenced herein. If you do not agree you should discontinue use of the services immediately. Wellbee Social Inc. retains the right to deny or suspend access to anyone we reasonably believe has violated any provision of this Privacy Policy. 

Interpretation and Definitions

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Privacy Policy:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by or is under common control with a party, where “control” means ownership of 50% or more of the shares, equity interest or other securities entitled to vote for election of directors or other managing authority.
  • Application means the software program provided by the Company downloaded by You on any electronic device, named Wellbee, or Wellbee Academy.
  • Business, for the purpose of the CCPA (California Consumer Privacy Act), refers to the Company as the legal entity that collects Consumers’ personal information and determines the purposes and means of the processing of Consumers’ personal information, or on behalf of which such information is collected and that alone, or jointly with others, determines the purposes and means of the processing of consumers’ personal information, that does business in the State of California.
  • Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to Wellbee Social Inc, d/b/a Wellbee Academy, 500 – 4th Avenue SW, Suite 2500, Calgary AB T2P 2V6.

For the purpose of the GDPR, the Company is the Data Controller.

  • Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
  • Country refers to: Alberta, Canada
  • Data Controller, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person which alone or jointly with others determines the purposes and means of the processing of Personal Data.
  • Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.
  • Do Not Track (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.
  • Personal Data is any information that relates to an identified or identifiable individual.

For the purposes of GDPR, Personal Data means any information relating to You such as a name, an identification number, location data, online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity.

For the purposes of the CCPA, Personal Data means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.

  • Sale, for the purpose of the CCPA (California Consumer Privacy Act), means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a Consumer’s personal information to another business or a third party for monetary or other valuable consideration.
  • Service refers to the Application or the Website or both.
  • Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

For the purpose of the GDPR, Service Providers are considered Data Processors.

  • Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
  • User refers to any natural person who uses the Website. By using our Website, you enter the category of “User”.
  • Website refers to Wellbee Academy, or Wellbee, accessible from https://wellbee.academy or https://www.wellbeeacademy.com
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

Under GDPR (General Data Protection Regulation), You can be referred to as the Data Subject or as the User as you are the individual using the Service.

Scope

This Policy applies to Wellbee Social, Inc., Wellbee Academy, websites, domains, applications, services, and products. The Website may include links to third-party websites, plug-ins, services, social networks, or applications. Clicking on those links or enabling those connections may allow the third party to collect or share data about you. If you follow a link to a third-party website or engage a third-party plugin, please note that these third parties have their own privacy policies and we do not accept any responsibility or liability for these policies. We do not control these third-party websites, and we encourage you to read the Privacy Policy of every website you visit. This Policy does not apply to third-party applications, websites, products, services or platforms that may be accessed through links that we may provide to you. These sites are owned and operated independently from us, and they have their own separate privacy and data collection practices. Any Personal Data that you provide to these websites will be governed by the third-party’s own privacy policy. We cannot accept liability for the actions or policies of these independent sites, and we are not responsible for the content or privacy practices of such sites. 

We will only use your personal information in accordance with this Privacy Policy unless otherwise required by applicable law. We take steps to ensure that the personal information that we collect about you is adequate, relevant, not excessive, and used for limited purposes. 

Our Commitments

  • We keep our staff trained in privacy and security obligations;
  • We obtain your consent where we need it to process your personal data (e.g for cookies) and ensure that suitable safeguards are in place before personal data is transferred to other countries.

  • How we collect, use, disclose, and protect the personal information of our customers and website users (”you”).

This Privacy Policy DOES NOT apply to information that:

  • We collect offline or through any other means. 
  • You provide to or is collected by any third party (including our affiliates and subsidiaries), through any application or content (including advertising) that may link to or be accessible from the Website. 

This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of this Website after we make changes indicates that you accept and consent to those changes, so please check the Policy periodically for updates. 

2. Information We Collect About You

Information that you provide us. 

We collect and use several types of information from and about you, including:

  • Personal information, that we can reasonably use to directly or indirectly identify you, such as your name, mailing address, e-mail address, telephone number, Internet protocol (IP) address used to connect your computer to the Internet, user name or other similar identifier, billing and account information, corporate information, and any other identifier we may use to contact you (”Personal Information”).
  • We provide an opportunity for any user to unsubscribe and opt-out from certain collections of information by emailing admin@wellbee.academy. You cannot opt-out of the collection of information we require to provide services to you. 
  • Non-personal information, that does not directly or indirectly reveal your identity or directly relate to an identifiable individual, such as demographic information, or statistical or aggregated information. Statistical or aggregated data does not directly identify a specific person, but we may derive non-personal statistical or aggregated data from personal information. For example, we may aggregate personal information to calculate the percentage of users accessing a specific Website feature.
  • Technical information, including your login information including username, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform, or information about your internet connection, the equipment you use to access our Website, and usage details such as when you last logged in, online status, and joining dates, inclusive of any tracking information regarding Your use of, and interaction with, the Services.
  • Non-personal details about your Website interactions, including the full Uniform Resource Locators (URLs), clickstream to, through and from our Website (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, or any phone number used to call our customer service number.
  • Any other types of information you provide to us through the Website.

3. How We Collect Information About You

We collect Personal Data from the following sources: 

From You. You may give us your Account Information, Contact, Payment Information, Financial Information, Demographic Data, Purchase Information, Content, Feedback, Feature Information by filling in forms, using our products or services, entering information online or by corresponding with us by post, phone, email, or otherwise. This includes information you provide if you register on our Website, place an order, or otherwise enter into an Agreement with the Company. 

This includes Personal Data you provide, for example, when you:

  • Register to join Wellbee Academy to become an authorized user;
  • Purchase products, courses, inclusive of registering for free and paid subscriptions on our website;
  • Create your profile page;
  • Participate in Events;
  • Enrolling in Courses;
  • Publish content such as, courses, blogs, certificates,  discussions, posts, videos, photos, quizzes, lessons, and assignments;
  • Create and join groups (communities);
  • Submit information relating to your credentials and qualifications, business diplomas and certificates, working hours, and the like in the Instructor Application;
  • Copies of government issued photo identification ID, inclusive of a photo with a Verification ID submitted via the platform, in order to issue a Verification Badge on the Service;
  • Place an order through our website and may be required to provide financial information. Such details of transactions you carry out through our Website and of the fulfillment of your orders will be collected. 
  • Create and submit content through our services and features on our website;
  • Download software and/or our mobile application;
  • Subscribe to our newsletter;
  • Complete a voluntary market research survey;
  • Contact us with an inquiry or to report a problem (by phone, email, social media, or messaging services and contact forms on our website);
  • When you log into our website;
  • Search queries on our website;

Automated Technologies or interactions. As you interact with our website, we may automatically collect the following types of data (all as described above): Device Data about your equipment (such as IP addresses), Usage Data about your browsing actions and patterns, and Contact Data where tasks carried out via our website remain uncompleted, such as incomplete orders or abandoned carts. We collect this data by using cookies, server logs, web beacons, and other similar technologies. Please see our Cookie section (below) for further details. We also use Information to improve our Services, including for analytics purposes.

Server Logs. We collect this information to prevent fraud and potential unauthorized access to your personal information, ensuring the technical availability and security of the Website. The server that hosts the Website may record requests your device makes to the server, the details on the device and browser you use, your IP address, date and time of access, city and country, operating system, browser type, and mobile network information. This data is used only for technical purposes – that is, to ensure the proper functioning and security of the Website and to investigate possible security incidents. Your device may also contain Logs, but their scope and retention period depend on your device’s manufacturer.

Third Parties. We may receive Personal Data about you from various third parties, including:

  • Account Information and Payment Information from another individual when they purchase a gift for you on our website, inclusive of paid subscriptions;
  • Name and email information from another individual when they send you an invite to join and create an account on the Service;
  • Device and Usage Data from third parties, including analytics providers such as Google; see section 9. 
  • Account information and Payment Data from social media platforms when you log in to our website using such social media platforms;
  • Content from communication services, including email providers and social networks, when you give us permission to access your data on such third-party services or networks;
  • Account Information and Payment Data from third parties, including organizations (such as law enforcement agencies), associations and groups, who share data for the purposes of fraud prevention and detection and credit risk reduction; and
  • Account Information, Payment Data, and Financial Data from providers of technical, payment and delivery services. 

If you provide us, or our service providers, with any Personal Data relating to other individuals, you represent that you have the authority to do so and acknowledge that it will be used in accordance with this Policy. If you believe that your Personal Data has been provided to us improperly, or to otherwise exercise your rights relating to your Personal Data, please contact us by using the information set out in the “Contact us” section below.

4. Types of Information That You Provide Us

Pursuant to your Sign up to become an authorized user and use of the Services, You may provide data to Wellbee Academy such as:

  • Account data. In order to use certain features (like accessing content, posting in the Wellbee Academy News Feed, enrolling and purchasing courses, or creating courses), you need to create a user account, which requires us to collect and store your email address, name, username and account settings. As you use certain features on the site, you may be prompted to submit additional information, including occupation, copies of diplomas/certifications as applicable.
  • Profile data. Such as photo, name, biography, website link, social media profiles, country, or other data. Your Profile Data will be publicly viewable by others. Your Profile Data will be publicly viewable by others. 
  • Instructor Application data. Such as copies of any relevant diplomas, disciplines of practice, affiliations to any organizations, business address, website, practicing and/or teaching hours, and copy of government issued photo ID if requested;
  • Shared data. Parts of the Services let you interact with other users or share content publicly, including by uploading courses and other educational content, posting reviews about content, asking or answering questions, sending messages to students or instructors, or posting photos or other work you upload. Such shared content may be publicly viewable by others depending on where it is posted.
  • Learning data. When you access content, we collect certain data including which courses, assignments, labs, workspaces, and quizzes you’ve started and completed; content and subscription purchases and credits; subscriptions; completion certificates; your exchanges with instructors, teaching assistants, and other students; and essays, answers to questions, and other items submitted to satisfy course and related content requirements.
  • Student Payment data. If you make purchases, we collect certain data about your purchase (such as your name, billing address, and ZIP code) as necessary to process your order and which may optionally be saved to process future orders. You must provide certain payment and billing data directly to our payment service providers, including your name, credit card information, billing address, and ZIP code. We may also receive limited information, like the fact that you have a new card and the last four digits of that card, from payment service providers to facilitate payments. For security, Wellbee Academy does not collect or store sensitive cardholder data, such as full credit card numbers or card authentication data.
  • Instructor Payment data. If you are an instructor, you can link your PayPal email account to the Services to receive and withdraw payments. When you link a payment account, we collect and use certain information, including your payment account email address. In some instances, we may collect ACH or wire information to send payments to your account. In order to comply with applicable laws, we also work with trusted third parties who collect tax information as legally required. This tax information may include residency information, tax identification numbers, biographical information, and other personal information necessary for taxation purposes. For security, Wellbee Academy does not collect or store sensitive bank account information. The collection, use, and disclosure of your payment, billing, and taxation data is subject to the privacy policy and other terms of your payment account provider.
  • Demographic data. Such as postal code, city, country, and age. 
  • Your data. Such as text, audio, video, blogs, awards, lessons, assignments, quizzes, and metadata content regarding Your uploads;
  • Transaction data. Such as payment and other details connected to Your purchases and subscriptions;
  • Communication data. Such as questions and feedback You send to Us. If you contact us for support or to report a problem or concern (regardless of whether you have created an account), we collect and store your contact information, messages, and other data about you like your name, email address, messages, location,  refund transaction IDs, and any other data you provide or that we collect through automated means (which we cover below). We use this data to respond to you and research your question or concern, in accordance with this Privacy Policy.
  • Financial data. Such as account numbers, payment card information, and related details;
  • Identity data. Such as national identification numbers, social security, and driver license details;
  • Usage data. Such as tracking information regarding Your use of , and interaction with, the Services;
  • Marketing data. Such as email preferences;
  • Analytics data. Such as data We create through analysis of Your use of the Services;
  • Other data. Any other data not specifically listed here collected regarding Your use of the Services;

The information we collect automatically is statistical data and does not include personal information. It helps us to improve our Website and to deliver a better and more personalized service, including by enabling us to:

    • Responding to your questions and concerns;
    • Sending you administrative messages and information, including messages from instructors, students, and teaching assistants; notifications about changes to our Service; and updates to our agreements;
    • Sending you information, such as by email or text messages, about your progress in courses and related content, rewards programs, new services, new features, promotions, newsletters, and other available instructor-created content (which you can opt out of at any time);
    • Sending push notifications to your wireless device to provide updates and other relevant messages
  • Provide and deliver products, information, and the Service itself to you;
  • To provide you with information, products and services that you request from us, including all required disclosures to governmental and regulatory bodies;
  • Process and fulfill orders and subscriptions;
  • Enable security features, remembering Your device, sending you security codes and emails with password reset links;
  • Enable social features, such as connecting You with other users and Third Party Services;
  • To provide users with communications, materials, and marketing announcements;

We will not share your email address with instructors or teaching assistants.
    • With Other Students and Instructors. Depending on your settings, your shared content and profile data may be publicly viewable, including to other students and instructors. If you ask a question to an instructor or teaching assistant, your information (including your name) may also be publicly viewable, and displayed on search engines, and anyone outside the Wellbee Academy platform.
  • Business Partners, Affiliates, Advisors and Transfer Participants. We may share your Information with our channel partners, subsidiaries, affiliates, professional advisors (such as financial, insurance, legal accounting, or otherwise), joint ventures, or any other company, to fulfill obligations and requests, to provide users information about Wellbee Academy and other purposes in Wellbee Academy’s sole discretion in its provision of the Services.         • Payment Processors. Wellbee Academy has partnered with Stripe and PayPal for all billing and secure payment transactions on the Service via WooCommerce checkout and billing management tool. You are encouraged to read and review WooCommerce, Stripe and PayPal’s Terms and Conditions and Privacy Policy before conducting any financial transaction on the Service. You may be able to pay for our services and products on the Website. To make a payment, we will redirect you to the webpage of the payment processor, and the payment processor will be collecting your personal data to carry out the payment operation.   • Course Emails. Automatic updates on lessons, quiz grades, course completions, instructor announcements will be sent to you via emails and are part of the course enrolment to provide the best learning experience for the course you have enrolled in. There are no opt out option for these emails as they are part of your purchase and course service experience.
We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Opting out of a network does not mean you will no longer receive online advertising.
